If they do nothing to defend their trademarks, they essentially give them up. That’s part of the deal...

I’m not defending the a$$hats, but I understand the way that it works.
For them to have a leg to stand on in defense of their intellectual property, they must show that they attempt to defend it regularly. If they do not, they may forfeit some of their trademarks/trade dress.
 
Fender tried the same thing 2009 and LOST ---

In the 70’s they did their thing with Ibanez...yet Orville was licensed to copy Gibson(overseas).
They have filed against Dean in the past....but they weren’t so publicly pubic about it.
 
When were the previous suits against Dean?
2017 is the earliest I can find................

Unfair because they are kicking Gibbos ARSE ---
-- the reality is IF Gibson does own the right to shape (Harley tried a SOUND and lost against --well EVERY Japanese Motorcycle maker) same deal-- better cheaper --
but IF Gibson can "own" a shape (which the previous court PROVED Fender couldnt) then why cant THEY MAKE THAT SHAPE AT THE SAME LOW COST AND HIGH QUALITY AS 52 other guitar makers around the globe?

In the lawsuit, Gibson alleges trademark infringement, trademark counterfeiting, unfair competition and trademark dilution on the part of Armadillo.
 
Point is, they’ve been continually active in defending their trademarks/trade dress over the years.
My Gladiator was knocked out of the market by them around 2011...

Ray has an SG Jr I used to have -- that WAS made by Michael Dolsey Designs.....he also no longer makes that shape--- but does make a BUNCH of Tele and Strat shapes..........

MAYBE this will be a great thing
MAYBE Dean is big enough to FIGHT BULLY GUITAR Inc Ltd. LLc. Esq. -- and WIN --- and then all these other folks who have been HIDING in the SHADOWS making QUALITY cheap guitars --- can come out into the light!

Basically, from what I understand about the subject, they have to get Richard-like with someone to show that they regularly attempt to defend their trademark/trade dress....this latest is clearly (IMHO) ILL ADVISED, AND JUST PLAIN DUMB. But it counts as an effort, on their part, in future defending...they can say, “Look! We’ve been down this path before....we feel that we invented the Flying V....we’ve tried to defend this as a trademarked property in the past....tell them to stop...please.”
 
OH FINE--- be all LOGICAL and sense making and crap----

Im still calling them Bully Guitar CO. Ltd.LLC.Inc.BBC.Esq. from now on Im also going to PAF/trademark that name --some day like they did their pickups-- or maybe I will put "OBL" on it like "Original Bill Lawrence" pickups when they arent -- (man they "F"ed that guy) -or any other underhanded bullspit crap the GIB has pulled --- glass houses and stones---kharma--- a good tomato soup --- they all come back around

point remains make a better product at a fair price and do your thing stop being all king Richard-like ;)

No problem here at all.
Fender is friendly about “licensing” their designs. Gibson is not.
Floyd Rose is also friendly about “licensing” their designs too...Fender, and Floyd are happy to collect licensing fees.
Do you get what I’m attempting to communicate to you though?(I see that you do now:))
Successful, or not, if you want to keep control over trademarked property, you have to show that you continually defend your rights to do so...or forfeit your trademarks.
You can also choose to license your trademarks to other parties, for a fee....and not be an a$$hat.

We could always decide to dig in to the trademark defending habits of.....KISS....for example.
They make Gibson look like angels. ;)

I'm not big on huge slab guitars with points sticking out all over the place
(even though I did play a bunch of weddings with a blue burst Dean Z...)
but I have to admit that I really like the look of that Wylde Explorer thing,
vertigo swirl and all. It needs lightening bolt fingerboard inlays though.

Look at the Schecter E1 in Purple Burst!!!!!!!!
