I am very sad. I had a judge go out of her way and make a questionably supportable decision just to side with the municipality in her district and rob an injured victim of his claim. This may affect a second client as well. I will appeal, but my faith has been shaken at its core.

Middle appeal as of right. The next court after that is discretionary. I am not hopeful. If I am unsuccessful, a new precident will be set since the current court went out of their way to contrive a dismissal, so nobody wants that affirmed. I better double check my spelling!!

Is precedent automatic? That isn't the case in the UK.

Every higher court is binding on every lower court. If this garbage decision is affirmed at the middle level, it will become the new law at the trial level. The only way to change that is to be granted an appeal by our highest state court, which is discretionary, and then convince them to overturn the middle court. Even if the higher court grants me that privilege, the middle court dedision will control in the interim.

So anyway....
Someone who holds a rather important position at which they are successful said they following to me tonight.

"I do not work hard, although I do work a lot. Work is only hard if you do not know what you are doing." I mentioned that trying to cure cancer sounds hard to which the person retorted "That is because they do not know how to do it yet."

I spent some time thinking about this and, if we ignore a bit of smugness, and we exclude physical labor from the conversation, I thought that there may be a thread of truth to this. Then I thought, it will continue to be "hard work" if the subject matter is not finite (and most are not) so that you can continue to grow the area for yourself and others - you know, strive for more. If you do not, you trade hard work for monotony.

That is as far as I have gotten. If I bored you, I am sorry. If this interests you, I would welcome some thoughts.
 
I see the point.......

If your comfortable in it --- its not hard work.....
Some might say that doing a fret file -- or rewire on a guitar is work......some have never done this ---so it LOOKS like work.

You do these things --- you know how to do these things-- so its work-- but not HARD work......

So anyway, I fell asleep in an MRI machine today. How is that for tired?

No worries BTW, just trying to see why my shoulder ain't the joint it used to be.
 
Oh man....that mri machine is a killer. You don't realize how difficult it is to not move, until your told not to move. Sleep Is a great move if you can pull it off.

I've been in way to many of those contraptions. Never fun. Of course, once you've had debridement, mri is a vacation.

Hope your sholder feels better. I wonder if thousands of guitars can hurt a shoulder. Hummmm.
Seriously, hope it's all good.

I am not sure if guitars hurt your shoulder, but fret jobs sure do!
 
Yup, I can see that hurting the shoulder.

So does crashing in a woop section, trust me. If you want to see what that looks like, go to MetLife stadium tomorrow. Can't wait!!
