Gibson is Flexing New Muscle

I dug into this point a little bit more. It seems, in this case, it isn't about confusing the guitars, themselves. It is about the name, "Hummingbird." This is where I think Gibson almost certainly wins.

After all, this is how we ended up with a Fender "Telecaster" guitar. As we know, the Telecaster was originally called the "Broadcaster". Well, Gretsch already had a line of drums on the market called the "Broadkaster" (spelled with a "K"). Gretsch sued Fender over the use of the "Broadcaster" name and won their case - even with the names being spelled differently. Of course, this forced the year of the "Nocaster" and subsequently renaming the guitar to "Telecaster." In this case, the issue had nothing to do with confusing the instruments. Who is going to confuse a guitar with a drum set!

So, the "Hummingbird" part of the lawsuit isn't about the guitar, itself. It is about infringing on the name. Honestly, I think Luna should have seen this coming, given the historic, legal precedent set with Gretsch vs. Fender.

I think this one will go to Gibson.

I dont own a V I have played one--- Ive been to the factory--- I Own a very nice Dean neck through bass that is as good in form function and quality as anyother gutiar in its class on the market
they make a low end bolt neck line "metalman" or something -- tjhose are Chinese adn built to price point
the upper end set neck stuff ----- EXCELLENT ----and IMHO built better than the $$$

Ok here is my question: Did Gretsch sue Fender as soon as they announced the "broadcaster" or did they wait a number of years? The major roadblock to Gibson right now is Tacit Consent. As far as I understand, if this is a "trademark infringement" case then you must defend that trademark at all times. allowing Dean to make these guitars for over 40 years without saying a word up until this point would mean that this whole case should be thrown out if that is indeed true.
