Fender wins in Germany

This is very, very interesting.

Not only does this decision apply to Germany, itself, but it applies to the entire EU.

The foundation of the decision is interesting, as well. Essentially, they found that the Stratocaster design "qualifies as a copyrighted work of applied art, reflecting original creative expression rather than purely functional design." The basis of the case was to counteract Chinese copies coming into Germany via AliExpress.

I wonder if Gibson is going to take a cue from this and attempt the same thing Europe.
 
I’ve been suspicious of many of Fenders business shenanigans over the years, but getting Europe to abide by their copyright laws is a smart move. The Chinese guitar manufacturing company, Yiwu Philharmonic Musical Instruments (what a name!) probably never asked or negotiated permission from Fender. Surprise, surprise… another Chinese manufacturer that violates copyright laws with impunity. But I guess now, it’s the European vendors of Yiwu’s products that will be on the hook.
