Hi Robert H. Herndon,

Thanks for the reply. I would be happy to give you a better explanation. Beginning in 2010, SoundCloud has used automated content identification to protect our creators’ copyrights.

When you upload a track, our system checks your upload against a database of protected tracks that copyright owners have asked us to block. If the system detects a match, then your content is blocked, because that’s what the copyright owner has asked us to do.

We also run the system in the background to make sure that we’re picking up infringing content on an ongoing basis after upload. If the system detects a sonic match, the track will be automatically removed.

While we understand that you have performance rights to this song "All Along The Watchtower" by Jimi Hendrix, though Harry Fox Agency, the problem is the automated system found a close sonic match to the original recording that is generally humanly impossible to duplicate to such a degree.

In cases like this, we must assume the track contains sampled or copied material from the copyright owner and our policy requires removal of the track.

Thanks for understanding that we have to remain in compliance with copyright law.

To learn more about copyright, please visit our copyright information page: soundcloud.com/pages/copyright.

Thank you,

David

Here's the banned version now hosted on our DropBox. Let me know if you encounter any trouble with the link:

And here's Hendrix's studio version of "All Along The Watchtower."

To my ears, the two tracks sound nothing alike. The 1992 DimMarrzio Virtual Vintage Solo has a much bigger voice than Jimi's Stratocaster had. Also, the slide parts are drastically different as Hendrix was said to have tuned to open 'D' and used a Zippo lighter for the slide part.

Now, here's Jimi's isolated track from a July 4, 1970 live performance in Atlanta of Watchtower, just so you can hear how differently the song is performed when you don't have multi tracks to rely on in the studio:

Funny they banned something so...ancient. Cool letter to get though!! You must be doing something right man.

My wife once got a cease-and-desist from Neil Schon (long story).

Why do they say the song is by Jimi Hendrix, when it is a Bob Dylan tune?

Cos although Dylan wrote it the two recorded versions are copywritten separately and don't sound anything alike. If you base your version on one or the other their stupid algorithm picks that one out to bitch about.

Good point. In general, the original composer has the rights to the song, but when it is re-arranged, the new arrangement can also be copyright protected. It is complicated, but there is a specific way of doing this.

What he said.... :-)

I'd love to hear the story!!!!

My wife used to run an online blog, basically a gossip thing. And one of her favorite targets was Neil Schon, because it was during a period when he was in the tabloids a lot and his wife was on one of those ridiculous "housewives" type shows, and there were some images circulating of him with his dong out. So my wife started taking some hilarious shots at him for his awful 'fro, little ween, and having been in such a terrible band. At first, either him or someone that worked for him sent some e-mails about how she was slandering him and better stop, so she didn't post any Schon stuff for a while but then he did some or another absurd thing and she went after him hard, especially his little weiner, and we got a cease and desist from his lawyer a couple days later.

It's a testament to what a narcissist the guy is that he ever even found her silly little blog, but the fact that he couldn't roll with someone joking about pictures that were all over the internet tells you just how touchy the dude is. At first she was just gonna go all First Amendment and ignore him but we realized the MF'er was just too sensitive and has too much money to let it go and it wouldn't be worth it.
