SO-- factor in your STATE sales tax when negotiating "deals" on reverb
 
Yup. This is the fallout from North Dakota vs. Wayfair, decided in 2018.

Essentially, in this decision, the Supreme Court reversed Quill vs. North Dakota from 1992.

What this boils down to is that a retailer no longer has to have a physical presence in a state for a state to levy taxes on sales that the retailer makes to that state.

I've already seen this in Sweetwater orders.
 
I spoke with a Reverb rep he said they have to charge (in this case Florida) sales tax on all sales regardless of if its a corporation or an individual making the sale--

to much "interstate" commerce to save tax$-- and too much NOT going to Uncle Samuel they gota NIP IT!

it has caused me to not "click" at times ..that surprise xtra ..nonsense...Reps at Sweetwater-ZZounds...if you if wor kit..will usually wave the sales tax to grab the sale..xtra 7% is a joke...maybe if i can go into my job in the city & not worrry about getting hit by bullets..i would gladly pay it

They may do that to make the sale, but they are still required to send the sales tax for the sale on to the respective state.

As more and more states begin insisting that sales taxes be remitted to them, I'm guessing we'll see less of businesses absorbing the sales tax.

The businesses would much rather not have to deal with this, as it just creates a headache for them.

yes..basically discount it for the tax..so the retailer get screwed..tax man gets paid...extorted again..all in favor of paying my share..but seems we have no say anymore...mindless sheep i call it....people doing things just because "the man" says so...not even looking at moral....ethical...financial responsibility..values anymore...hey rant of day over,,off the city to look at some trash in streets & seeing my hard earned tax payer money at work....
 
I used to be able to negotiate 10% off plus NOT pay tax at places like Sweetwater...now I'm lucky to negotiate the tax off!

I also just sold a pedal on Reverb and I got hit with the tax!!! Me the seller, not him the buyer! So now I have to build that into my sales price.

Craigslist and Facebook local sales are looking better. Forum sales between individuals has not been hit either...
 
it puts an added pressure on the dealers..its already competitive..so tax on our paycheck..tax on buying goods..but not a double dip on seller & buyer..that is too much..someone is making 10-15% off used merchandise..it was already sold new & collected..so why again? my business has def gotten more expensive over the years..but i will not raise my prices..all day everyday..holiday..reg day..weekend..same fee...dont even take all their money at times...watching people pull out change to pay me... do have to run it right but every once in awhile

2014 , Chuck E Cheese..show to unlock a car...a crying Spanish girl..its the B day party for her daughter...she pulls out the saved money..in an envelope..they couldn't go in...about 15 of em saying stuff i had no idea of....sat & talked to them for a sec..saw the lil girl with bow on her head....went in & paid for their party...you know how many keys i have made for that Spanish community in last 7 years !!! a whole bunch..i am the white guy that was nice to them..lol...my whole business has been built by caring..putting service first..now there always is rhe couple idiots...15 guns in 8 years on us...

So, Reverb took the sales tax out of the final sales price and sent it on to the state in question?

Yes, they deducted it from my earnings. I filed a complaint. Sales tax should be put on the buyer as I have found no way to add it in my sales pages other than a note in the description.

They are only collecting for about a dozen states right now. They need to set the web site up to add it automatically to the buyer at checkout like Amazon does.

The way it works in some states is that there has to be a minimum number of sales and/or dollar amount to a particular state to be required to pay sales tax. So, if you're a small time seller or only sell occasionally, you may not have to pay any sales tax.

Other states are so strict that they even require people who are just having a one-time yard sale to obtain a temporary sales tax permit and collect sales tax! Of course, this is nearly impossible to enforce, but it is the law in many states.

Frankly I'm getting tired of it. I already pay over 30% of my income in taxes. Now everything I buy including USED items are taxed. How many times does tax need to be paid on an item?

The original purchaser paid the tax on the full value of the item. Then it gets taxed again every time it's sold...ridiculous!

Yup. It's pretty frustrating.

The same thing happens when you buy a used car, at least here. When I buy a used car, I have to pay the tax on the car as part of my vehicle registration process.

But, these things don't just happen. They happen because elected officials created a tax bill which was signed into law by another elected official.

Yet, ironically, many of these same people keep getting re-elected.

Americans seem to have a complete blind spot when it comes to making the association between burdensome laws and the people they elect.

I too ran into this recently-- with a sale -- and I was charged (as the seller) NJ tax......I bitched-- they said OH sorry that is the BUYERS responsibility---then HE got nailed for it---almost lost the sale over it--
Recently LOST one other guitar sale over it
AND in a recent BUY ---argued (both I the buyer in this case, AND the seller both argued it and Reverb "waived the tax" ) --

the argument being
1 not a new instrument
2 seller was NOT a business-- individual "Jeff" selling to individual "Adrian" for personal use---reverb agreed -- but it took 5 days and a SHITE TON of emails-- honestly to save about 25.00 ........but we both (seller and I ) agreed it was the DAMN PRINCIPAL of the thing
so.........there might be loopoles -- -does reverb(etsy) accurately record and track every sale to include and contribute the exact correct tax to each state? (Im betting not) -- -further more are they collecting said tax and sitting on it (reinvesting it) elsewhere to gain INTEREST off it before submitting to the gubment???? (I would be) a good computer nerd could write a program that would do just that and over the course of a few years net a GOODLY sum of $ I bet.........

So Reverb points fingers at Uncle Slam ---- HE IS MAKING US--- but dont cry to hard for them Smitty --- at that level of commerce they arent LOSING $ on collecting tax......I assure you.
