Switchblades: Just out of curiosity...

Welcome to the land of fruits and nuts.

I bought me one of those thingys in Mexico back in 1981 and smuggled it across the border.

Illegal Pocket Knives
New York City follows state laws, so some types of pocket knives are illegal to possess in the city as well as throughout the state. Switchblades and gravity knives are two common examples. State law defines a switchblade as any knife with a blade that opens automatically by applying pressure to a button, spring or other device on the handle. A gravity knife is any knife with a blade that's released by the force of either gravity or centrifuge, such as by flicking it open, and that stays open.

Illegal Knife Lengths
Under New York City's administrative code, you cannot possess a knife with a blade that is 4 inches long or longer. This means that even if you possess a pocket knife that is legal under state laws, it could still be illegal in New York City if the blade is too long. There are a few exceptions to this rule, such as if a chef is transporting such a knife to her place of employment. New York City also prohibits knives from being openly displayed in public unless they are being used for a lawful purpose, such as if a Boy Scout is participating in scout activities.

NY knife laws are very subjective.
What is Legal to Own

It is legal to own a hunting knife
It is legal to own a dirk or dagger
It is legal to own a stiletto

BUT with regard to possesssion
The law provides that when a person is found in possession of a dirk, dagger, or stiletto, there is a presumption that the possessor intended to use it as a weapon against another. This presumption can be rebutted in Court; however, a person can still be arrested and charged with a crime, even if he or she did not intend to use the weapon unlawfully against another.

What is Illegal to Own

It is illegal to own a pilum ballistic knife
It is illegal to own a metal knuckle knife
It is illegal to own a cane sword
It is illegal to own throwing stars
It is illegal to own any knife if you are not a U.S. citizen
It is illegal to own any knife adapted for use primarily as a weapon
It may be illegal to own a gravity knife, without a valid hunting and/or fishing license
It may be illegal to own a switchblade knife, without a valid hunting and/or fishing license

So even where legal to own

It is illegal to carry a dirk, dagger, or stiletto with the intent to use it as a weapon against another.
New York does not have concealed carry laws, therefore it is legal to open or conceal carry any knife that is legal to own and that the carrier does not intend to use unlawfully against another.

So, basically, it is for a jury to decide your intent in carrying it if anything goes down. My advice is to leave you knives at home, which effectively reduces the benefit of owning many of the knives you can own.

Here’s how it goes here:

It is legal To own any kind of blade and keep it anywhere.

It is illegal To carry it, though, if It is considered an “attack/defense instrument”, i.e. If it has no practical use other than human confrontation.

A typical stiletto switchblade is, therefore, illegal To carry, though legal To own, unless you can prove a definite non-agressive purpose for carrying one around

You can sell it, you just better hope someone is buying it. But you know what they say: better to be judged by 12 than carried by 6
